End User License Agreement (EULA)

ALO Cloud Platform – powered by DOMA Automation s.r.l.

Effective Date: April 1st 2025

This End User License Agreement ("Agreement") is a legal contract between DOMA Automation s.r.l., Via E. Rossi 6, 52100 Arezzo (Italy), VAT ID IT02260270513 ("Provider"), and you ("User") for the use of the ALO Cloud Platform hosted on *.cloud.alo.zone, operated under the brand ALO.

By creating an account or using the ALO Cloud Platform, the User accepts and agrees to be bound by the terms of this Agreement.

1. Grant of License

The Provider grants the User a limited, non-exclusive, non-transferable license to access and use the ALO Cloud Platform solely for uploading, managing, and processing digital content (such as photos and creations) made using ALO hardware.

Reverse engineering, copying, sublicensing, redistribution or modification of the software or services is strictly prohibited.

2. User Content

  • The User retains full ownership of all content uploaded.
  • By uploading content, the User grants the Provider a non-exclusive, worldwide, royalty-free license to store, display, process, and back up the content for the purpose of providing the service.
  • The User confirms that they have the full legal rights to all uploaded content and that such content does not infringe any third-party rights, copyright, trademarks, or applicable laws.
  • The User is solely responsible for the legality, accuracy, and safety of their content.

3. Cloud Instance Naming

Users may choose a name for their individual cloud instance. However:

  • The chosen name must not infringe upon any third-party trademark, copyright, or intellectual property rights.
  • The Provider reserves the right to suspend or rename instances violating this policy.

4. Acceptable Use

Users must not:

  • Upload or share unlawful, offensive, defamatory, or harmful content.
  • Use the service for illegal or unauthorized purposes.
  • Attempt to bypass technical restrictions or security features.

The Provider may suspend or terminate access in case of violations.

5. Service Availability and Warranty Disclaimer

The ALO Cloud Platform is provided "as is" and "as available".

The Provider makes no warranties, express or implied, regarding uptime, compatibility, or suitability for a particular purpose. Service interruptions, loss of data, or delays may occur due to system maintenance or third-party issues (e.g., cloud infrastructure).

6. Limitation of Liability

Under no circumstances shall the Provider be liable for any indirect, incidental, or consequential damages.

The Provider’s total liability is limited to the amount paid (if any) for the service in the last 12 months.

7. Data Processing and Privacy

The Provider processes personal and content data in accordance with its Privacy Policy.

Data is stored on secure servers and may be backed up for operational integrity. The service is compliant with the General Data Protection Regulation (GDPR).

8. Artificial Intelligence & Image Processing

The User agrees that content may be processed using AI algorithms (e.g., for clipping, enhancement, shadows). These processes are automated and aim to improve image quality but may introduce minor alterations.

9. Software Disclosure and Use of Odoo

The ALO Cloud Platform is built using the open-source framework Odoo, which is debranded where possible in accordance with Odoo’s LGPL license and usage terms.

The use of Odoo in this platform complies with the license and does not violate any of Odoo S.A.’s distribution rights.

10. Intellectual Property

All trademarks, designs, and branding associated with ALO and the ALO Cloud Platform remain the exclusive property of DOMA Automation s.r.l. The platform’s custom logic and interface components are proprietary.

11. Termination

The Provider may suspend or terminate any User account for breach of this Agreement or for operational reasons. Upon termination, the User’s data may be retained for 30 days, after which it may be deleted without further notice.

12. Modifications

The Provider reserves the right to modify this Agreement at any time. Users will be notified of any changes by email or platform notification. Continued use of the platform after such changes implies acceptance.

13. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Italy. Jurisdiction: Court of Arezzo (Italy).
